These Terms of Use apply to your use of the Driftlight mobile application and website (“Driftlight”).

By downloading, accessing or using Driftlight, you agree to these Terms.

1. About Driftlight

Driftlight is a wellbeing application designed to provide a simple visual breathing and bedtime ritual. It uses gently changing light to help users slow down and relax before sleep.

Driftlight is not a medical device and does not provide medical advice, diagnosis or treatment. It is not intended to treat insomnia, sleep disorders, anxiety or any other medical condition.

If you have concerns about your sleep, breathing or health, you should seek advice from an appropriately qualified healthcare professional.

2. Free access

New users may receive access to Driftlight free of charge for approximately 72 hours from the time their free-access period begins.

This free-access period is provided to allow users to try Driftlight before deciding whether to subscribe.

The availability and duration of promotional or free-access periods may change for future users, but this will not retrospectively alter a subscription that has already been purchased.

3. Driftlight Premium

After the free-access period ends, continued access to Driftlight requires an active Driftlight Premium subscription.

The current subscription option and price are displayed within the app before purchase. Prices may vary by country or region and are displayed in your local App Store storefront where available.

Purchases made through the Apple App Store are processed by Apple and are subject to Apple's applicable payment and App Store terms.

4. Automatic renewal

Driftlight Premium is an auto-renewing subscription.

Unless you cancel, your subscription will automatically renew at the end of each subscription period. Your Apple Account will be charged in accordance with the terms displayed by Apple when you subscribe.

You can manage or cancel your subscription through your Apple Account subscription settings.

Cancelling prevents future renewal. You will normally retain Premium access until the end of the subscription period for which you have already paid.

5. Price changes

Subscription prices may change in the future. Any price changes will be handled in accordance with the rules and notification or consent requirements of the applicable App Store.

The price presented by the App Store when you purchase or renew your subscription is the applicable price for that transaction.

6. Refunds

Payments and refunds for subscriptions purchased through the Apple App Store are handled by Apple and are subject to Apple's applicable refund policies.

Driftlight does not directly process App Store payments.

7. Using Driftlight safely

Driftlight contains changing levels of light and visual animation.

You should stop using the app if its visual effects cause discomfort, dizziness, eye strain or any other adverse reaction.

Do not use Driftlight in circumstances where looking at or interacting with your device could create a safety risk, including while driving or operating machinery.

8. Availability and changes

We aim to keep Driftlight available and functioning reliably, but we cannot guarantee that the app will always be available, uninterrupted or error-free.

We may update, modify or discontinue features where reasonably necessary, including to maintain compatibility, security, reliability or improve the service.

9. Intellectual property

Driftlight, including its design, branding, software, graphics and original content, is owned by or licensed to the developer of Driftlight and is protected by applicable intellectual property laws.

You may use Driftlight for your own personal, non-commercial use in accordance with these Terms and the applicable App Store licence terms.

You may not copy, modify, distribute, reverse engineer or commercially exploit Driftlight except where applicable law expressly permits you to do so.

10. Third-party services

Driftlight may rely on third-party services to provide certain functionality, including services relating to app distribution, subscriptions and analytics.

Your use of those third-party services may also be subject to their respective terms and policies.

11. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer law.

To the extent permitted by law, Driftlight is provided on an “as available” basis and we are not responsible for losses arising from circumstances outside our reasonable control or from use of Driftlight for purposes for which it was not designed.

Nothing in these Terms affects any statutory rights you may have as a consumer.

12. Apple's Standard EULA

If you download Driftlight through Apple's App Store, your licence to use the application is also subject to Apple's Standard Licensed Application End User License Agreement, unless another applicable licence agreement is presented to you.

13. Changes to these Terms

We may update these Terms from time to time, for example to reflect changes to Driftlight, applicable law or the services we use.

The latest version will be published on the Driftlight website with the date it was last updated.
